How Contracts Work

Achieve Excellence with Life Navigation Network Project

Contracts are legally binding agreements between two or more parties. Many everyday decisions involve contracts, even when people do not realize it. Renting an apartment, accepting a job, financing a vehicle, signing up for a phone plan, or agreeing to online terms of service can all create legal obligations.

Understanding how contracts work helps you recognize when an agreement becomes legally enforceable and what responsibilities you may be accepting by signing or agreeing to something.

When You Can Legally Enter a Contract

In British Columbia, most people gain full legal capacity to enter contracts at age 19, when they reach the age of majority. This means contracts you enter are generally considered legally binding.

Minors may still enter certain contracts, but these agreements may not always be enforceable in the same way. Because of this, many businesses require someone to be the age of majority before signing certain agreements such as leases, loans, or long term service contracts.

Understanding when you have legal capacity is important because once you are legally able to enter contracts, the agreements you sign can create enforceable obligations.

What Makes a Contract Legally Binding

For a contract to be legally valid, several key elements must exist.

Offer

One party proposes specific terms or conditions.

Acceptance

The other party agrees to those terms.

Consideration

Something of value is exchanged between the parties. This is often money, services, or goods.

Capacity

Both parties must have the legal ability to enter the agreement.

When these elements are present, a contract can usually be enforced in court if one party fails to fulfill their obligations.

Types of Contracts

Contracts can take many different forms. Not all contracts are written documents.

Written contracts

Formal agreements that are documented and signed by the parties involved.

Verbal agreements

Spoken agreements that may still be legally binding if the required elements of a contract exist.

Digital agreements

Online contracts where users accept terms through electronic signatures or by clicking agreement boxes.

Implied contracts

Agreements created through actions or behavior rather than explicit statements.

Even when a contract is not written, the law may still recognize it as binding depending on the circumstances.

Levels of Contract Validation

Different types of agreements require different levels of validation depending on the importance or legal requirements of the document.

Simple agreements

Basic contracts between parties that do not require additional verification beyond mutual agreement.

Signed contracts

Documents signed by the parties to confirm their agreement to the terms.

Witnessed documents

Contracts where a third party observes the signing and confirms that it occurred.

Notarized documents

Documents verified by a notary public who confirms the identity of the parties and the authenticity of the signatures.

Legally registered agreements

Certain contracts, such as property transfers or security interests, may need to be registered with government systems to become legally enforceable against others.

Understanding these levels helps you recognize when additional legal steps are required for an agreement to be valid.

  • leases for housing
  • employment agreements
